This is the License Agreement in restriction with either Personal version
or Professional version whichever you use.
The license agreement is subject to change without any notice. The most
updated license agreement found on www.reiji.net
shall be effective.
1. General.
The software and documentation accompanying this License whether on disk,
in read only memory, on any other media or in any other form (collectively
"SOL Software") are licensed, not sold, to you by Sakurai Optical
Lab. ("SOL") for use under the terms of this License, and apple
reserves all rights not expressly granted to you. The rights granted herein
are limited to SOL's and its licensors' intellectual property rights in
the SOL Software and do not include any other patents or intellectual
property rights. You own the media on which the SOL Software is recorded
but SOL and/or SOL's licensor(s) retain ownership of the SOL Software
itself.
2. Permitted License Uses and Restrictions.
This License allows you to install and use one copy of the SOL Software
on a single computer at a time. The SOL Software may be used to reproduce
materials so long as such use is limited to reproduction of non-copyrighted
materials, materials in which you own the copyright, or materials you
are authorized or legally permitted to reproduce. This License does not
allow the SOL Software to exist on more than one computer at a time, and
you may not make the SOL Software available over a network where it could
be used by multiple computers at the same time. Except as and only to
the extent expressly permitted in this License or by applicable law, you
may not copy, decompile, reverse engineer, disassemble, modify, or create
derivative works of the SOL Software or any part thereof. Under any circumstance,
use of the SOL Software for any other purpose other than its primarily
desired purpose (realization of out-of-focus and realization of depth-of-field
in digital visual production) is strictly prohibited. THE SOL SOFTWARE
IS NOT INTENDED FOR USE IN THE OPERATION OF NUCLEAR FACILITIES, AIRCRAFT
NAVIGATION OR COMMUNICATION SYSTEMS, AIR TRAFFIC CONTROL SYSTEMS, LIFE
SUPPORT MACHINES OR OTHER EQUIPMENT IN WHICH THE FAILURE OF THE SOL SOFTWARE
COULD LEAD TO DEATH, PERSONAL INJURY, OR SEVERE PHYSICAL OR ENVIRONMENTAL
DAMAGE.
3. Professional License.
It is necessary for you to purchase the Professional License directly
from SOL to process a digital image larger than 300 x 300 pixels with
SOL Software. Unlocking this limitation without authority is strictly
prohibited. Before the purchase of the Professional License, you are premised
to have tested and confirmed the functionality of the SOL Software sufficiently
with the Personal version. SOL does not refund any amount of purchase
price regardless of the reason. In addition, SOL does not support use
of the SOL Software under any other computer system, condition or circumstance
than SOL prescribes.
4. Transfer.
You may not rent, lease, lend or sublicense the SOL Software to any third
party or person.
5. Termination.
This License is effective until terminated. Your rights under this License
will terminate automatically without notice form SOL if you fail to comply
with any term(s) of this License. Upon the termination of this License,
you shall cease all use of the SOL Software and destroy all copies, full
or partial, of the SOL Software.
6. Disclaimer of Warranties.
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE SOL SOFTWARE IS AT
YOUR SOLE RISK AND THAT THE ENTIRE RISK AS TO SATISFACTORY QUALITY, PERFORMANCE,
ACCURACY AND EFFORT IS WITH YOU. EXCEPT FOR THE LIMITED WARRANTY ON MEDIA
SET FORTH ABOVE AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW,
THE SOL SOFTWARE IS PROVIDED "AS IS", WITH ALL FAULTS AND WITHOUT
WARRANTY OF ANY KIND. SOL DOES NOT WARRANT AGAINST INTERFERENCE WITH YOU
ENJOYMENT OF THE SOL SOFTWARE, THAT THE FUNCTIONS CONTAINED IN THE SOL
SOFTWARE WILL MEET YOUR REQUIREMENTS, THAT THE OPERATION OF THE SOL SOFTWARE
WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE SOL SOFTWARE
WILL BE CORRECTED. SHOULD THE SOL SOFTWARE PROVE DEFECTIVE, YOU ASSUME
THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION. SOME
JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS
ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO THE ABOVE EXCLUSION AND
LIMITATIONS MAY NOT APPLY TO YOU.
7. Limitation of Liability.
TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHAL SOL BE LIABLE FOR
PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL
DAMAGES WAHTSOEVER, INCLUDING, WITHOUT LIMITATION, DAMGES FOR LOSS OF
PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION OR ANY OTHER COMMERCIAL DAMAGES
OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE
SOL SOFTWARE, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT,
TORT OR OTHERWISE) AND EVEN IF SOL HAS BEEN ADVISED OF THE POSSIBILITY
OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY
FOR PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS
LIMITATION MAY NOT APPLY TO YOU. In no event shall SOL's total liability
to you for all damages (other than as may be required by applicable law
in cases involving personal injury) exceed the amount of five thousand
Japanese yen (5,000 yen). The foregoing limitations will apply even if
the above stated remedy fails of its essential purpose.
8. Controlling Law and Severability.
This License will be governed by and constructed in accordance with the
laws of Japan, as applied to agreements entered into and to be performed
entirely within Japan between Japanese citizens. This License shall not
be governed by the United Nations Convention on Contracts for the International
Sale of Goods, the application of which is expressly excluded. If for
any reason a court of competent jurisdiction finds any provision, or portion
thereof, to be unenforceable, the remainder of this License shall continue
in full force and effect.
9. Complete Agreement; Governing Language.
This License constitutes the entire agreement between the parties with
respect to the use of the SOL Software licensed hereunder and supersedes
all prior or contemporaneous understandings regarding such subject matter.
No amendment to or modification of this License will be binding unless
in writing and signed by SOL. Any translation of this License is done
for local requirements and in the event of a dispute between the Japanese
and any non-Japanese versions, the
Japanese version of this License shall govern.
10. Publication (effective with SOL software licenses issued on March
9th, 2005 or later.)
In case of publication or exhibition of products that you created with
SOL software regardless of the media and form of publication such as movie
film, broadcasting film (excluding commercial films), DVD and video game,
the name of SOL should be credited. (->
Refer to the credit title format (Online).) You shall agree that SOL
has the right to announce to the public in any form of publication your
products that you created with SOL software. In case that you are not
the copyright holder of the products (such as commissioned products),
you shall, at your responsibility, advise the copyright holder to credit
the name of SOL. You shall contact SOL, should it be the case that you
dare not to credit the name of SOL or to have SOL announce the use of
SOL software in your products. (->
Refer to the guideline (Online) ) If any violation of the conditions
above occur, we will void the SOL software license without any reimbursement
and you may not publicize those products. You shall defray any cost occured
in case of any legal acts (including expenses incurred in defending SOL).
11. Privacy.
Every customer of the SOL software licensed by SOL is to agree that its
name to appear as correspondent of SOL on documents such as its official
website written by SOL itself.
12. Patent.
The SOL Software has been applied for patent in various countries. Beware
of this fact when you develop any software resembling to the SOL Software.
It is a violation of patent if the software you develop is distributed
for free of charge. Beware of the SOL Software's patent even when you
develop and sell any software resembling to the SOL Software in the countries
where SOL has not applied for patent but possibly used in the countries
where SOL has applied for patent, especially when you release it through
internet. The License shall not be granted to any party who has an intention
of developing software resembling to the SOL Software.
